National Council of Exchangors, hereinafter, individually and collectively,
"Operator", make no guarantee, express or implied, whatsoever,
as to the accuracy of information on this website, or as to the suitability
for use by User of said information. Information regarding particular
real property has not in any way been verified, tested, or necessarily
even seen by Operator. The information contained herein may contain
misinformation and is subject to error, omission, correction, withdrawal,
inaccuracy, and so forth.
2. User is 100% responsible to independently verify any and all facts,
material, immaterial, or otherwise, which are contained in this website
and upon which either User or third parties, through or on behalf
of User, may rely. User is advised to use competent outside professional
services, such as attorneys, accountants, appraisers, etc. for such
information verification.
3. Operator is not offering for sale or exchange any of the real estate
identified herein, nor is Operator acting as agent or sub-agent for
any owner of real property or broker or agent of same. This real property
information on this website is for informational purposes only.
4. Operator will not knowingly accept or print an advertisement or
present any other information which discriminates on the basis of
sex, race, creed, color, religion or ethnic origin.
5. Operator has made no guarantee or promise, express or implied,
whatsoever, as to the safe-keeping of any information stored on this
website. All information stored hereon is subject to theft, loss,
withdrawal, or removal at any time and for any reason, with no prior
notice to User. User agrees to make independent backups of all data
that is of any value to User. User further agrees to not place any
information on this website, which if lost, stolen, or disclosed would
cause damage or loss to User or any third parties.
6. If User or any third party, through or affiliated in any way with
User, suffers any loss, direct or indirect, caused by information
contained in this website, or altered on, or removed from this website,
whether said loss is caused by the negligence, recklessness, or intentional
act or omission of Operator, then, User agrees to hold harmless, protect,
defend, and indemnify Operator from any such loss or action which
may be initiated as allegedly resulting from the act or omission of
Operator.
7. Any information placed on this website by User, or on behalf of
User, is, to the best knowledge of User, accurate and complete. User
will not place real property information on this website unless User
has a legally valid written real estate listing agreement for, or,
alternatively, owns, said property. No later than such time as any
such listing expires or ownership terminates, User will notify Operator
to remove said information from this website.
8. In no event shall the liability of Operator exceed the sum of $500.00
(five hundred dollars)
9. User agrees that the terms of this Agreement are severable. If
any term or provision is declared invalid or unenforceable, that term
or provision will be construed consistent with applicable law as nearly
as possible to reflect the original intentions of the parties, and
the remaining terms and provisions will remain in full force and effect.
10. User agrees that this Agreement shall be governed in all respects
by and construed in accordance with the laws of the State of California,
United States of America, excluding its conflict of laws rules. User
and Operator each submit to exclusive subject matter jurisdiction,
personal jurisdiction and venue of the United States District Court
having jurisdiction in the geographic district covering San Luis Obispo,
California. If there is no jurisdiction in said court, then jurisdiction
shall be in a court of competent jurisdiction in the State of California.
11. Any unauthorized copying, reproduction, distribution, publication
and or commercial use of this work, or any part thereof, is a violation
of the proprietary rights of Operator, including the copyright laws
of The United States of America. This includes, by way of illustration
and not limitation, the collection of personal information about our
users from the content of this website for any commercial use or purpose
whatsoever.
